Weyburn church wins appeal over proposed location of liquor store

WEYBURN - The Calvary Baptist Church has won their second appeal of the decision to allow the Liquor Spot to locate in the building immediately adjacent to them, after they lost their initial appeal.

The church is located at the corner of 16th Street and First Avenue, and the building next door is owned by John Hulbert Construction.

This second appeal went to the Saskatchewan Municipal Board’s planning appeals committee.

The appeal was won on account of the City "misapplying" and “violating” various bylaws.

As a result of this decision, the appeal presented by John Hulbert Construction to the City of Weyburn regarding the crossing of the buffer strip behind their property has been deemed "moot". John Hulbert Construction had also appealed the decision not to allow the use of the back alley, as they planned to use this to access the back for storage and warehousing of liquor products.

In the initial appeal made by the church, the appeal board had decided against the City that they could not allow an exception for the Liquor Spot to use the back alley, but they would still allow the Liquor Spot to be in that location, as it is discretionary.

At the time, pastor Tim MacKinnon said the second appeal was launched “based on our view that this would set an unsettling precedent for the future when it comes to liquor and cannabis stores being around schools, public places, etc.”

“The Church expresses best wishes to the Hulberts, The Liquor Spot and the City of Weyburn going forward,” said a statement from the church board on Wednesday.
