Young offender sentenced in 98th Street home invasion

A young offender who pled guilty to his role in the 98th Street home invasion case will receive a sentence of 20 months in open custody and 10 months probation.

A young offender who pled guilty to his role in the 98th Street home invasion case will receive a sentence of 20 months in open custody and 10 months probation.

The youth, who cannot be named under the Youth Criminal Justice Act, had entered guilty pleas to being party to the offence of break and enter to a residence and thereby committing aggravated assault, and also to the charge of membership in a criminal organization - in this case, the Native Syndicate.

The individual was 16 years old when he and seven other individuals were involved in the Jan. 27 invasion of a residence believed to belong to a member of a rival gang. The group was able to enter the residence and the occupant, Lance Moosomin, was struck with metal pipes.

The attack was in retaliation to a home invasion committed by another gang against one of their own members. The group discovered, however, they were in the wrong house attacking wrong individual.

Judge Dan O'Hanlon noted the accused took an XBox belonging to the victim and ran out the back door.

In imposing sentence the judge noted the "mental, emotional and psychological harm" done to the victim and the case's "profound effect on the community."

In addition to the open custody sentence and probation, the youth was given a two years weapons prohibition running from the date of release.

The sentence follows up on the guilty plea and sentence imposed against Ryan Osecap, who pleaded guilty to break and enter/aggravated assault as well as to membership in a criminal organization. He was sentenced in May to five years and four months in jail.

A third accused in the 98th Street case, Irene Littlepoplar, appeared in provincial court Tuesday by video link from custody in Saskatoon. She faces six charges with respect to the home invasion case including robbery, break and enter and membership in a criminal organization. Littlepoplar has elected a Queen's Bench trial by judge alone. Dec. 9 and 16 are set as dates for a preliminary hearing to be held in provincial court.
