David Smith, Cody Mooswa appeared in North Battleford Court Thursday, July 29 via video call at 11 p.m.
There is an update ordered for Smith who has been serving time for many charges including an indecent act and sexual assault. Smith wishes to serve his probation period in a trailer near Wilkie which is close to family and friends. This bail update verification was adjourned to Aug. 6, where Smith will appear again in court via video call from the Saskatoon Correctional Centre.
RCMP charged Mooswa for breaching curfew and fighting while intoxicated May 4, 2010 at 11:50 p.m. He plead guilty on the breach of no alcohol/no drugs. Mooswa was then arrested June 29, as he was found intoxicated, again.
Through joint submission he is sentenced to 30 days probation with a consecutive 30 days. He has been in custody since June 29 therefore the first charge has been waived as time served. He used poor judgement in recreational use of drugs and alcohol but does not have addiction issues. The fail to stop at scene of accident charge has been released on re-cognisant. After released, Mooswa will have a residence curfew from 11 a.m. to 7 p.m., will not be able to enter bars or liquor stores and will comply to drug testing.
