Three individuals charged in the treaty land entitlement fraud case at Mosquito First Nation are planning to go to trial.
Chief Clarence Stone, Clifford Spyglass and Gerald Bird have all elected to be tried in Court of Queen's Bench by judge alone. The three are charged with stealing from and defrauding Mosquito First Nation of over $5,000 during 2002. Spyglass and Bird also face breach of trust charges.
The election was made Wednesday morning in provincial court. Only Bird was present in court before Judge Dan O'Hanlon, while counsel were in attendance for both Stone and Spyglass.
A preliminary hearing for all three individuals has been set for May 30, 2011 in provincial court in North Battleford. It is scheduled to run for two weeks.
Two others, Alphonse Moosomin and Eldon Starchief, have already pleaded guilty to breach of trust charges in the case in August.
