The City of North Battleford will be partially compensating a North Battleford couple who built a fence that later was declared to be in contravention of the zoning bylaw.
City council unanimously passed a resolution to compensate Blair and Sharon Huard for $1,400, representing 50 per cent of the material costs for the fence at their property on 113th Street. The resolution also approved allowing the timeframe to remedy the fence height to extend to Oct. 31.
The Huards attended council Sept. 13. Sharon Huard made a presentation to council where she explained they had obtained permission from Building Inspector Jerry Wintonyk and City Planner Tim LaFreniere for the fence construction and yard development, even though a permit was not necessary.
The fence was purchased, landscaped and built based on that approval, but that approval was rescinded on appeal to the Development Appeals Board based on the sole objection of neighbors at one of the homes nearby. They stated the fence would obstruct their view and depreciate their property value.
The Huards had sought reimbursement of all expenses incurred in the building of the fence as a possible solution.
