An oversight by the City has been cleared up through a Memorandum of Understanding (MOU).
An MOU 鈥渉as been entered into with the property owners of 50 Broadway Street West to sell a closed laneway and street and to rectify an encroachment by the City at the Skateboard Park location. As consideration the City would provide a five year lease at the rate of $1.00/year to one of the co-owners for the encroachment of the business abutting 115 Palliser Way,鈥 explained City Clerk Kathy Ritchie at the regular meeting of Yorkton Council Monday.
The Provincial Government has confirmed that the City may lease the subject highway right-of-way, in accordance with conditions set out in The Cities Act.
As well, The Cities Act, stipulates that the lease agreement itself, shall include a provision that the council may either terminate the lease on six months鈥 written notice if council considers it necessary to provide public access to the street that has been closed, or that the lessee shall grant public access to the street that has been closed, if the council provide the lessee with 30 days鈥 written notice, added Ritchie.
